By accessing or using the CalorieAI mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

CalorieAI is a nutrition tracking application that uses artificial intelligence to estimate the calorie and macronutrient content of food based on user-provided descriptions. The App provides personalized calorie targets, tracks food intake, monitors weight, and offers AI-powered coaching insights.

3. Not Medical Advice

CalorieAI is NOT a medical device and does NOT provide medical advice. The information, estimates, and recommendations provided by the App are for general informational purposes only and should not be considered professional medical, nutritional, or health advice.

AI-generated calorie and macronutrient estimates may be inaccurate. Actual nutritional content of food may vary significantly from estimates. Do not rely solely on CalorieAI for managing medical conditions, weight loss, or dietary requirements.

You should consult with a qualified healthcare provider, registered dietitian, or other appropriate professional before:

• Starting any diet or weight management program
• Making significant changes to your eating habits
• Using this App if you have any medical conditions, including eating disorders, diabetes, or heart disease
• Making decisions that could affect your health based on information from this App

4. User Responsibilities

You agree to:

• Provide accurate information when using the App
• Use the App in compliance with all applicable laws and regulations
• Keep your account credentials secure and confidential
• Not share your account with others
• Not use the App for any unlawful or prohibited purpose
• Not attempt to reverse engineer, decompile, or hack the App

5. Accuracy and Limitations

CalorieAI uses AI models to estimate nutritional information. These estimates are approximations and may be inaccurate due to:

• Variations in food preparation, portion sizes, and ingredients
• Limitations of AI models and natural language processing
• Incomplete or ambiguous food descriptions
• Differences between food items that share similar names

We make no warranties or representations about the accuracy, completeness, or reliability of any information provided by the App.

6. Subscriptions and Payments

CalorieAI offers optional paid subscriptions ("Plus" and "Pro") with additional features. By purchasing a subscription:

• You authorize us to charge your payment method for the subscription fee
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage or cancel your subscription through your device's App Store settings
• Refunds are handled according to Apple App Store or Google Play Store policies
• We reserve the right to change subscription pricing with advance notice

We do not process payments directly. All purchases are handled by Apple or Google, and their terms and refund policies apply.

7. Account Termination

You may delete your account at any time through the App's Settings screen. Deleting your account will permanently erase all your data, including food logs, weight history, and preferences. This action cannot be undone.

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

8. Intellectual Property

All content, features, functionality, and design of CalorieAI are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALORIEAI AND ITS DEVELOPERS, OWNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You use CalorieAI at your own risk. The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Indemnification

You agree to indemnify and hold harmless CalorieAI and its developers, owners, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, violation of these Terms, or violation of any rights of another party.

11. Data and Privacy

Your use of CalorieAI is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the App. Continued use of CalorieAI after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of competent jurisdiction in the United States.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
